Terms of Use

These Terms of Use ("Terms") govern your use of the Momento mobile application ("App") operated by SDM Global Inc. ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

You must be at least 13 years of age to use Momento. By using the App, you confirm that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

To use Momento, you must create an account using a valid email address and password. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

Please notify us immediately at help@momentomoments.com if you become aware of any unauthorized use of your account.

Momento is a personal memory journal that lets you capture, organize, and revisit meaningful moments in your life. You can create moments with titles, notes, dates, photos, optional locations, moods, and tagged people.

Free users can create and access moments from the most recent 30 days. Moments older than 30 days become part of your archive and are accessible with a Premium subscription.

Momento offers an optional auto-renewing subscription ("Momento Premium") that provides ongoing access to your full archive of moments older than 30 days. As new moments pass the 30-day threshold each day, your accessible archive grows continuously.

Subscription pricing is displayed in the App prior to purchase and may vary by region. Payment is charged to your Apple ID at confirmation of purchase.

Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID Account Settings.

All payments and billing are processed by Apple. SDM Global Inc. does not collect or store your payment information.

Subscriptions are non-refundable except as required by applicable law or Apple's refund policies.

We may offer a free trial period for Momento Premium. If a free trial is offered, the duration and terms will be clearly stated before you subscribe. Your subscription will automatically begin billing at the end of the free trial unless cancelled beforehand.

You retain full ownership of any content you create or upload through Momento, including text, photos, and location data. We do not claim any intellectual property rights over your content.

By using the App, you grant SDM Global Inc. a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the service to you.

You are solely responsible for the content you create. You agree not to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or that violates any applicable laws or third-party rights.

You agree not to:

- Use the App for any unlawful purpose or in violation of these Terms.

- Attempt to reverse-engineer, decompile, or otherwise access the source code of the App.

- Use automated means to access or scrape the App.

- Interfere with or disrupt the integrity or performance of the App.

- Attempt to gain unauthorized access to any accounts, systems, or networks associated with the App.

You may delete your account at any time from within the App (Me tab > Delete Account). Upon deletion, your data is permanently removed from our servers.

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the App will be available at all times, error-free, or free from security vulnerabilities.

To the fullest extent permitted by applicable law, SDM Global Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or related to your use of the App.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in California.

We reserve the right to update these Terms at any time. If we make material changes, we will notify you through the App or by updating the date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
